SOCIAL MEDIA TERMS OF USE

1. GENERAL

(i) Our Facebook pages, Twitter accounts, Instagram accounts, YouTube channels, Google+ accounts and such other social media platforms (collectively, "social media channels") are social media locations for community members, users or followers ("User(s)" or "you") to connect to and learn about Abbott Laboratories (Singapore) Private Limited ("Abbott") and Abbott products, specifically in Singapore, through information, pictures, videos, posts, communications and other media ("Content") concerning initiatives and programs.

(ii) Abbott's goal is to provide useful and interesting information about our brand and products as well as to engage with consumers through our Content in an open and respectful dialogue relating to the specific issues and topics covered in our posts or tweets or other multi-media.

(iii) Your access and use of the Abbott social media channels is subject to these Terms of Use ("Terms") as well as the terms of use of any platform from which you accessed the social media channels.

2. ETIQUETTE

As a User, in your use of, or access to, the Abbott social media channels, you shall:

(a) Comply with all applicable laws, regulations, official requirements;

(b) Be subject to all policies, in particular as they may pertain to social media, of Abbott;

(c) Ensure that all rights, licenses and permissions as may be necessary to post such Content have been obtained by you;

(d) Ensure that your identity is neither anonymous nor fake;

(e) Disclose any material connection to Abbott when posting about Abbott or our products by using the hashtag #sponsored or the specific hashtag created by Abbott that discloses such connection between the User and Abbott or by stating such relationship directly in the post or Content. A material connection means the User has an affiliation with Abbott (e.g. a paid relationship) or is paid in kind or otherwise incentivized to talk about Abbott;

(f) Refrain from any conduct that is or may be regarded as: dishonest, deceptive, illegal, immoral, defamatory, offensive, malicious, obscene, intimidating, discriminatory, harassing, extortive or threatening;

(g) Not post or circulate any hate propaganda, calls to violence of any kind, make any comments that could harm the image or interests of any country or monarch, disturb public order or market order;

(h) Not post, publish or provide any Content that is false or misleading;

(i) Not post, publish or provide any news about current events (unless such content pertains to Abbott);

(j) Not attempt to use the Abbott social media channels to directly or indirectly offer goods or services whether or not of a commercial or private nature;

(k) Not engage in any activities that may result in spam (including any form of automatically generated content or the repeated posting of certain content) being directed at Abbott or User or other third party or member of the public;

(l) Not post, publish or provide any Content that is or may be regarded as medical advice (whether solicited and/or verified);

(m) Not post, publish or provide any Content that is or may constitute an unapproved use of any Abbott product;

(n) Not engage in any activity that may constitute a potential infringement of any intellectual property rights, including but not limited to, confidential information, patents, brand names, trademarks or trade names, logos, copyrights or trade secrets of any party or entity;

(o) Not post, publish or provide any Content that contains unsubstantiated product claims, including those that reference a celebrity or third-party brand;

(p) Not post, publish or provide any Content that may be regarded as off-topic or disruptive of the purposes of the respective Abbott social media channels; and

(q) Not post, publish or provide any Content from fake or anonymous Users.

3. RELEVANCE

The Abbott social media channels are not an appropriate place to resolve disputes, issues, complaints or suggestions about individual sales and service experiences in relation to our products. This does not mean we do not want to hear about such issues, but these types of concerns are best handled by trained representatives. If you’re interested in sharing comments or feedback outside the scope of these channels, you can send us a message through the "Contact Us" tab or such other contact information available on the respective Abbott social media channels. Comments may be forwarded to other Abbott departments and personnel to ensure appropriate follow-up takes place.

4. LICENSE

(i) You agree that by posting any Content on the Abbott social media channels, you grant Abbott a worldwide, non-exclusive, irrevocable, royalty-free license (with the right to sublicense) to use, copy, reproduce, process, adapt, modify, publish, transmit and display and distribute such Content in any and all media or distribution methods now known or later developed.

(ii) Further, by submitting Content you represent and warrant to Abbott that you are the sole owner of the Content and that Abbott's use of the Content as set forth in these Terms will not violate the rights (in particular intellectual property rights) of any third party.

(iii) You shall indemnify and keep indemnified, defend and hold harmless, Abbott from any and all claims arising from any breach of these Terms or the license granted or any representation or warranty made herein.

5. COMPLIANCE

(i) Abbott reserves the right to delete, change, adapt, remove, amend any aspect of the Abbott social media channels (including the entire channel) at any time and from time to time with or without notice and in particular to ensure full compliance with these Terms by all Users.

(ii) Without limiting the generality of the foregoing, Abbott may: (i) add, remove, record or modify any Content, (ii) block disruptive Users or any User that does not comply with these Terms; (iii) discontinue any part or parts of the Abbott social media channels at any time; and/or (iv) report to the applicable authorities any Content that may be in violation of these Terms or applicable laws and/or regulations.

(iii) In particular, Abbott may, in its sole and absolute discretion, delete any Content that it deems as inappropriate or that is or may be in contravention of these Terms, including any Content that is otherwise inconsistent with the purpose of the Abbott social media channels.

(iv) Abbott may, in its sole and absolute discretion, amend any part or parts of these Terms at any time and from time to time with or without notice.

6. DISCLAIMER

(i) Your use of the Abbott social media channels is entirely at your own risk. Abbott accepts no liability and specifically disclaims any and all liability howsoever arising out of your use of or reliance on the Abbott social media channels and/ or any Content appearing or accessible therein.

(ii) Discussion of medical and health topics should never be construed as medical advice. You are advised to contact a health care professional in your area if you need medical advice. Abbott does not represent that the information on or accessed via the Abbott social media channels is true, accurate, complete, reliable, useful, timely or current.

(iii) You read all Content at your own risk. Do not rely on the information or advice in any of the Content.

(iv) Abbott does not create, control, represent, or endorse any opinions or statements expressed by Users of the Abbott social media channels, including those that Follow/Like the Abbott social media channels and those Followed/Liked by Abbott and that any Content posted by anyone other than Abbott is the responsibility of the relevant User and not Abbott. 

(v) Any hyperlinks from the Abbott social media channels, including those that relate to any social media channel, website, and/or other digital asset are not under the control of Abbott, and Abbott shall not be responsible or liable for any content or information obtained therefrom, any terms and conditions of use, privacy policy, or any further links from any such site. 

(vi) The inclusion of any such hyperlink from the Abbott social media channels is provided for convenience and does not imply endorsement of the linked site by Abbott. Any following of another User's account, "likes" of another page, re-tweets, "favorites," shares, or re-posts another User's content, shall not constitute any endorsement of such User or of such Content by Abbott.

(vii) All Content submitted by Users on the Abbott social media channels shall be deemed to be in the public domain. No obligation of confidence shall attach to such Content. Abbott shall be free, without limitation or condition, to disclose and use the ideas contained in such Content on a non-confidential basis to anyone without any liability to you. 

(viii) Content appearing on the Abbott social media channels may subject Users to the laws and regulations governing such social media channels. Abbott complies with all applicable laws and regulations, and cooperates with investigations conducted by the relevant authorities.

(ix) Do not use the Abbott social media channels to submit any solicited or unsolicited idea(s). If any such ideas are submitted, any User, including Abbott, may use these ideas as their own. Abbott shall not be liable and specifically disclaims any liability in respect of any claim(s) relating to any ownership rights any User may have in relation to such idea(s). If you submit any such idea(s), you agree that you shall not be entitled to any compensation or reward in relation to the use of any such idea(s). Abbott specifically does not waive any rights to use similar or related ideas previously known to us, developed by our employees, or obtained from other sources.
